More than likely, you think of criminal offenses as distinguished by misdemeanor and felony charges.  However, what you might not realize that this language is not used in New Jersey law.  Instead of using this terminology, New Jersey classifies certain crimes as indictable offenses.  These are more serious charges and are heard in New Jersey Superior Court, conveniently located at the county seat. 
Let’s start with an examination of cases that are heard in municipal court.  Not all matters are considered criminal offenses.  However, that’s not to say that you should not seek experienced legal counsel for certain traffic offenses.  For example, it might surprise you to learn that DWI/DUI cases are considered motor vehicle charges under New Jersey law.  Notwithstanding, you could still incur substantial penalties for a conviction evolving from driving while under the influence charges.

  • Simple assault charges
  • Shoplifting up to a specified amount
  • Disorderly persons offenses (includes select drug offenses)
  • Obstruction of justice
  • Criminal Mischief
  • Trespassing
  • Passing bad checks up to specific dollar amounts

Indictable Crimes in New Jersey
